The aim of this legal notice is to regulate the terms that govern the operation of the website www.artium.eus created by Fundación Artium de Álava (hereinafter the Foundation, inscribed in the Foundations Registry of the Basque Country with registration number F-98. VAT code: G-01315530), with the aim of providing information for the free and personal use of its users.
As indicated below, the access to and use of the contents of the website are the exclusive and sole responsibility of the user and imply the acknowledgment and acceptance by the user of the terms contained in this legal notice and referenced documentation.

USE
The user bears full responsibility for utilising the portal. Should it be necessary for the user to register in any way in order to gain access to specific contents of the portal, he/she shall be responsible for providing lawful, correct information. In this process, the user is provided with a password, which he shall use diligently and confidentially.
The user undertakes to utilise the contents and services in an adequate manner as set out below and he/she shall not use them in order to: carry out illicit or illegal activities or those that violate the precepts of good will or public order; disseminate contents or propaganda of a racist, xenophobic, pornographic-illegal nature, in defense of terrorism or which poses a threat to human rights; cause damage to the physical and computer systems of Artium Museum, of its suppliers or third persons; introduce or disseminate in Internet computer virus or any other physical or logical systems that may cause the aforementioned damage; and/or try to gain access to and, if appropriate, use the e-mail accounts of other users and modify or manipulate their messages.
CONTENTS
The contents of artium.eus are placed at the disposal of the user by the Foundation; these come from its own sources and those of third parties.
The Foundation ensures that the contents are of the highest quality possible and are reasonably up to date, but does not guarantee their utility, precision, thoroughness, pertinence and/or up-to-datedness.
INTELLECTUAL PROPERTY RIGHTS
The Fundación Artium de Álava has permission to reproduce and broadcast publicly the texts and graphical elements that appear in this website. The user recognises that the aforementioned contents are protected by intellectual property rights, which, should it be the case, correspond to the Fundación Artium de Álava and to those considered to be the authors, or their heirs, in accordance with current legislation in the field of intellectual property.
No intellectual property rights are granted over www.artium.eus, and the user is expressly forbidden to reproduce, transform, distribute, broadcast publicly, provide, extract, reuse or utilise in any way, by any means or procedure, any of these, except in those cases when this is legally permitted or authorised by the proprietor of the corresponding rights and when indicated in each specific case.
The public broadcasting of the contents of the website shall not imply, in any case, the granting, waiver or transfer, be this total or partial, of the corresponding intellectual property rights.
The Foundation respects the intellectual property rights of third parties and users are responsible for determining and satisfying such rights or other restrictions regarding their use before copying, broadcasting or making use of the protected elements.
USE FOR INFORMATION PURPOSES BY THE MEDIA
The Foundation authorises media professionals to take pictures of the exhibitions strictly for information purposes as provided for in article 35 of the Revised Text of the Intellectual Property Law. The images that the Foundation provides through its media services are subject to the same conditions.
The use of images that reproduce works of art is subject to current legislation and especially to the aforementioned Intellectual Property Law. The users of such images shall be responsible for applying for any authorisations and/or permits that may be required and, if appropriate, for paying royalties to the owners and to the management entities that represent them.
The Foundation does not accept any responsibility for any consequence arising from the unlawful use of reproductions of works of art exhibited in Artium Museoa.

www.artium.eus provides the user with access to websites or Internet portals belonging to or managed by third parties, and does not accept any responsibility for the contents, services and any material of any nature existing on such websites not managed directly by the Foundation to which the user may be referred by means of links.
LIABILITY
The Foundation does not accept any responsibility for any damage of any kind that may be due to a lack of exactness, thoroughness, up-to-datedness, or any errors or omissions in the contents of artium.eus or other contents to which access may be had through this website, nor does it accept any duty or commitment to verify nor to monitor their contents and information. Likewise, it does not accept any responsibility for the opinions expressed by users through any participative tool existing at this time or that may be developed in the future.
Likewise, the Foundation does not guarantee the availability, continuity or infallibility of the operation of artium.eus and as a result, excludes, to the maximum extent permitted in current legislation, any responsibility for damages of any kind that may be due to the lack of availability or the continuity of the operation of the website, as well as errors in its access.

FRIENDS OF THE MUSEUM PROGRAMME
Via www.artium.eus, the Foundation offers its users the possibility of becoming members of the "Friends of the Museum" programme by completing the online application form. Payment may be made, according to the selected option, by means of a standing order (through the bank account number provided) or by means of credit card. In both cases, the Foundation will keep bank details in order to manage the annual renewals of the Programme, and users may have access in order to rectify, cancel or modify their data or oppose its processing at any time in accordance with the terms of our personal data protection policy.
DATA PROTECTION
The personal details collected through this website shall be included in a file for which the Foundation shall be responsible, in order to perform in an adequate manner the work of developing, performing and managing the services of the museum, attend to enquiries and send information or news should the user have subscribed to this service. Artium shall respect in all cases, the confidentiality and integrity of such data and undertakes to use it in accordance with the described purpose, as well as to comply with all the legally established requirements in these cases.

Data Treatment Activities Register
The request must be clearly indicated, dated and signed, as well as your address or email for notification purposes. When the Artium Foundation has reasonable doubts about the identity of the person making the request, it may ask that they attach a photocopy of their ID or equivalent document.
Likewise, and provided that the user has requested this through the subscriptions bulletin, the Foundation shall occasionally send by means of e-mail, information relating to its activities, initiatives and services.
Generally, and unless otherwise stated on the corresponding form, the Foundation does not process Personal Details relating to children under 14. Should the details of children under 14 be requested for any reason on an occasional basis, this would be done in a letter sent to their parents and guardians, in a restricted manner, without any possibility of identification, and with the sole objective of collecting this on the corresponding form.
Exceptionally, the user may provide the personal details of third parties should this be permitted on the form and provided that the prior and informed consent of the third party in question has been obtained. It is the sole responsibility of the user to manage and have obtained the prior consent of third parties and shall be responsible for any damages that might occur due to any failure to comply with such an obligation.
APPLICABLE LAW AND JURISDICTION
Both users and the Foundation subject themselves, with the express waiver of any other rights that might correspond to them, to the Judges and Courts of the city of Vitoria-Gasteiz (Álava), with regard to any controversy that might arise in the interpretation of this legal notice.
